The RV Escape Legal

Terms & Conditions

Effective September 24, 2026 · RV Resort LLC (The RV Escape)

This is our agreement with you. It explains in detail how to book a tour, how much to pay and when, what happens if a tour is canceled or rescheduled, what we promise you, and what we ask of you on the road. Please read it before you pay: by paying a deposit, you agree to these terms.

The key points

  • The deposit is $1,000 per person for tours of 5 days or longer and $800 for 3–4 day tours. The balance is due no later than 14 days before the start date.
  • Cancel more than 30 days before the tour and we refund everything you paid, minus a $150 per-person administrative fee.
  • Cancel 30 days or less before the tour and your payment is non-refundable, but the full amount you paid can be applied to any other tour of ours within 12 months.
  • If we cancel the tour, you choose between a full refund or moving to another tour.
  • Certain events (for example, Burning Man) have special terms, which are listed on the event page.

1. General Terms

1.1. These Terms & Conditions (the “Terms”) are an offer by RV Resort LLC, a company registered in the State of New Jersey, USA, doing business as The RV Escape (“we,” “us,” “our,” or “The RV Escape”), to enter into an agreement with you for the organization of RV travel on the terms set out below.

1.2. You accept these Terms, and a binding agreement is formed between you and us, when you pay the deposit or any other payment for a tour by any of the methods listed in Section 6. Submitting an inquiry on the Website does not, by itself, obligate you to anything.

1.3. Only an adult (18 or older) with full legal capacity may book a tour. If you book a tour on behalf of other people, you confirm that you are authorized to act for them and that they have read these Terms and our Privacy Policy, and you are responsible for payment for the entire booking.

1.4. In addition to these Terms, the agreement includes: the tour description on the Website as of the booking date; the written booking confirmation we send you (by messenger or email); and the RV house rules we send you before the trip. If anything we have agreed with you in writing conflicts with these Terms, what we agreed in writing applies.

2. Definitions

  • Website means thervescape.com and all of its pages.
  • Tour means a group trip following an itinerary published on the Website, or a custom itinerary agreed with you in writing.
  • RV means the recreational vehicle in which Travelers ride and live during the tour.
  • Lead Booker means the person who books and pays for the tour.
  • Traveler means each person who goes on the tour, including the Lead Booker.
  • Deposit means the first payment, which secures a spot on the tour.
  • Tour Credit means an amount that can be used toward another tour of ours instead of a refund (Section 7.4).
  • Start Date means the first day of the tour according to the itinerary.

3. What We Provide

3.1. We organize and run small-group RV tours across the USA. Depending on the tour, the price includes the items listed under “Included” on the tour page, which typically are:

  • accommodation in the RV for the entire route;
  • transfers along the itinerary with our driver (you don’t have to drive the RV);
  • campground and RV park fees;
  • meals as specified in the tour itinerary;
  • activities, admission tickets, and equipment listed in the itinerary;
  • Starlink Wi-Fi, and a shower and restroom on board;
  • guidance and support throughout the tour.

3.2. The price does not include anything listed under “Not Included” on the tour page or anything not stated as included, such as: travel to and from the starting point, airfare, insurance, paid entertainment outside the itinerary, personal purchases, souvenirs, tips, fines, and any costs resulting from your own actions or decisions.

3.3. We do not sell airline tickets and are not an air or rail carrier. Third-party services included in the tour (campgrounds, ferries, parks, excursions, equipment rentals, restaurants, wineries) are provided by those third parties under their own rules; we book and pay for them on your behalf as part of the itinerary.

3.4. Groups are limited to 8 Travelers unless the tour page states otherwise. The exact number of beds and the sleeping arrangement (for example, a private bedroom or a bed in a shared area) are shown on the tour page and in your booking confirmation.

4. Tour Information and Pricing

4.1. The itinerary, dates, prices, and sleeping arrangements are listed on the tour page. We work to keep this information accurate, but photos and descriptions are for illustration only: specific campsites, meals, and the order of activities may differ from the description (see Section 8.3).

4.2. All prices are in US dollars per person unless stated otherwise. Prices may change until you pay your deposit. Once your deposit is paid, the price of your spot is locked in and will not increase, unless you change the services you booked.

4.3. Discounts, promo codes, and loyalty program benefits are applied under the rules published at the time of booking and, unless stated otherwise, cannot be combined. Discounts are applied at the time of booking and cannot be claimed retroactively.

5. How to Book a Tour

5.1. Submit an inquiry on the Website or message us. We will confirm availability, answer your questions, and send you payment details.

5.2. Your spot is secured once we have received your deposit. Until then, we cannot guarantee a spot, as each tour has a limited number of spots.

5.3. After you pay, we will send you a written confirmation showing the tour name and dates, the names of the Travelers, the sleeping arrangement, the amount received, the balance due, and the balance due date. Please review it and let us know right away if anything is incorrect.

5.4. If a tour is full, we can add you to the waitlist. Joining the waitlist is free and does not guarantee a spot.

5.5. Before the tour, we will ask for the names of all Travelers, an emergency contact, any dietary restrictions and allergies, and any other information needed to book campgrounds, ferries, and parks.

6. Payment

6.1. The deposit per Traveler, unless the tour page states otherwise, is:

  • $1,000 for tours of 5 days or longer;
  • $800 for tours of 3–4 days.

6.2. The balance is due no later than 14 days before the Start Date. If you book less than 14 days before the Start Date, the full price is due immediately.

6.3. Payment methods: Zelle, Venmo, PayPal, cash, and any other methods we specify. The payer covers any fees charged by their own bank or payment service. A payment is considered made when we receive the funds. When paying, please include the tour name and the Traveler’s name in the payment memo or in your message to us.

6.4. If the balance is not paid on time, we will send you a reminder. If payment is not received within 3 days of the reminder, we may cancel the booking and offer the spot to others; in that case, our cancellation policy for cancellations by you (Section 7) applies based on the date of cancellation.

6.5. We do not receive or store your payment card details; payments are processed by banks and payment services.

6.6. On request, we will provide a payment confirmation or receipt.

7. Cancellations and Changes by You

7.1. Cancellations must be made in writing, by email to hello@thervescape.com or in the messenger thread you use with us. The cancellation date is the date we receive your message (New York time).

When you cancelWhat happens to your payment
More than 30 days before the Start DateWe refund everything you paid, minus a $150 administrative fee per canceling Traveler
30 days or less before the Start DateNo refund. The full amount you paid becomes a Tour Credit toward another tour of ours (see 7.4)
No-show, late arrival for the start, leaving the tour after it begins, or skipping part of the itinerary during the tourNo refund and no Tour Credit

7.2. Refunds are issued using the same method as the original payment, within 14 days of receiving your cancellation notice. If a direct refund by that method is not possible (for example, for cash payments), we will agree on another method with you.

7.3. The administrative fee covers the costs we incur when you book: prepayments to campgrounds and partners, holding spots, and planning work.

7.4. Tour Credit:

  • may be used toward any tour of ours with a Start Date within 12 months of the Start Date of the canceled tour;
  • may be transferred to another person with written notice to us;
  • if the new tour costs less, the difference remains as Tour Credit for the same period; if it costs more, you pay the difference;
  • cannot be exchanged for cash and will not be extended if not used in time, unless we have agreed otherwise in writing.

7.5. Replacing a Traveler. You may transfer your spot to another person at no extra charge if you give us their name before the tour starts and they accept these Terms. If the change requires rebooking with third parties (for example, ferry tickets), the Lead Booker pays the rebooking costs.

7.6. Changing your booking. If you want to change your sleeping arrangement or the number of Travelers, we will do so subject to availability; any price difference will be charged or adjusted. Reducing the number of Travelers is treated as a cancellation for those who are no longer traveling.

7.7. Some costs cannot be refunded even if you cancel more than 30 days in advance, if you asked us in advance to buy something specifically for you (for example, individual event tickets or a private excursion) and we notified you of this in writing. Those amounts will be deducted from your refund.

8. Cancellations and Changes by Us

8.1. If we cancel the tour for reasons on our side (for example, the minimum group size is not met, the RV breaks down, or a guide becomes ill), we will let you know as early as possible and, at your choice, we will:

  • refund everything you paid for the tour in full, with no fees, within 14 days; or
  • transfer your payment to other dates or another tour.

In that case, our liability is limited to refunding the amount you paid us; we do not reimburse costs you incurred on your own (airfare, pre-tour hotels, vacation time). That is why we recommend buying refundable tickets or trip cancellation insurance.

8.2. Vehicle replacement. If the RV breaks down or becomes unusable before or during the tour, we may replace it with an equivalent vehicle or arrange other transportation and accommodation of a comparable standard.

8.3. Itinerary changes. RV travel depends on weather, road conditions, and park rules. We may change the order of days, drive times, and campsites, and replace individual stops and activities with equivalent ones, when required by safety, weather, road, park, or campground closures, government requirements, or other circumstances beyond our control. Such changes do not entitle you to a refund. If a significant part of the itinerary is not delivered through our fault, we will offer proportionate compensation.

8.4. Guide or driver replacement. We may replace a driver or guide with another qualified person.

9. Force Majeure

9.1. Force majeure means events beyond the parties’ control that could not have been foreseen or prevented, including natural disasters, hurricanes, snowstorms, wildfires and smoke, floods, earthquakes, epidemics, closures of parks, roads, and borders, government actions, strikes, military actions, and widespread communication and transportation outages.

9.2. If a tour cannot take place due to force majeure, the full amount you paid for the tour becomes a Tour Credit toward another tour of ours on the terms of Section 7.4. If force majeure occurs during a tour and continuing is unsafe or impossible, we will help arrange your return; the value of the unused portion of the tour, minus costs we have already incurred, will be converted into Tour Credit toward another tour.

9.3. Neither party is liable for failure to perform its obligations if the failure is caused by force majeure, provided that it notified the other party of those circumstances as soon as possible.

10. Special Events and Custom Tours

10.1. Special events. Tours to festivals and events with limited tickets (for example, Burning Man, All Inclusive Burn, After Party, and similar events) may have special payment, cancellation, and refund terms, including being fully non-refundable. These terms are listed on the event page and take precedence over these Terms. Tickets to the festival itself are sold by its organizer under its own rules, unless the event page expressly states that the ticket is included in the price.

10.2. Custom itineraries. The price of a custom tour is calculated per day and is shown on the “Custom Itinerary” page as of the booking date. What is included in the base price (for example, route planning, our driver and up to 300 miles of driving per day, RV parks, water hookups and tank dumping, Starlink Wi-Fi, shower, restroom, and beds) and which services cost extra (meals, BBQ, e-bikes, camping gear, a trailer, additional beds, a guide) are listed on that page and in the written quote we send you. Mileage beyond what is included, additional services, and route changes during the trip are charged as agreed. The deposit amount, payment deadlines, and cancellation terms for a custom tour are stated in the written quote; if they are not stated there, Sections 6 and 7 apply.

11. Rules on the Road

11.1. The trip means living as a small group in one RV, so we ask everyone to:

  • arrive at the meeting point on time; we can only wait for latecomers within reason so the itinerary isn’t disrupted for everyone else;
  • follow the RV house rules we send before the tour, as well as the rules of campgrounds and national and state parks, including the Leave No Trace principles;
  • not smoke, vape, or use open flames inside the RV (only outside, in permitted areas);
  • take care of the RV, the equipment, and other Travelers’ belongings;
  • be respectful of other Travelers and guides, and keep quiet at night;
  • follow safety instructions from the driver and guides;
  • not bring or use illegal substances, and not bring weapons;
  • drink alcohol only if you are 21 or older, and in moderation; alcohol on board is served only to those of legal drinking age under US law.

11.2. If a Traveler damages the RV, equipment, or third-party property through their own fault, they must pay the cost of repair or replacement, as well as any fines imposed on us because of their actions (for example, by a campground or park).

11.3. We may remove from the tour any Traveler whose behavior threatens the safety, health, or comfort of the group, breaks the law or the rules, or who is severely intoxicated. In that case, no refund is given, and the Traveler must arrange and pay for their own trip home.

11.4. Luggage space is limited by the size of the RV. We will tell you in advance how much you can bring; please pack in soft bags rather than large hard-shell suitcases.

11.5. Pets are allowed on a tour only with our prior written approval.

12. Children

12.1. Children under 18 may join a tour only when accompanied by a parent or legal guardian, who books their spot and is responsible for their safety and behavior throughout the tour.

12.2. Whether children can join, the minimum age, and the need for child car seats must be agreed before booking; not all tours and activities are suitable for children.

13. Health, Safety, and Outdoor Activities

13.1. Our itineraries include walks and hikes, bikes and e-bikes, SUP, kayaking, swimming, and other activities. All outdoor activities carry risks, including injuries, falls, insect bites, exposure to the weather, and distance from medical care. Participation in every activity is voluntary: you decide whether to take part based on your own health and experience, and you may opt out of any activity.

13.2. Before booking, please tell us about any health conditions, allergies, pregnancy, mobility limitations, or medications that could affect the trip, so we can assess whether the tour is right for you and prepare. We use this information only for your tour (see our Privacy Policy).

13.3. For certain activities, we or our partners (for example, a kayak rental) may ask you to sign a waiver and a health questionnaire. Without a signature, you may not be able to take part in that activity; this does not entitle you to a refund.

13.4. We are not medical professionals. In an emergency, we will call emergency services and help you get to a medical facility; the cost of medical care is paid by the Traveler or their insurance.

13.5. Please always wear a seat belt while the vehicle is moving if your seat has one, and avoid moving around the cabin unless necessary.

14. Travel Documents, Insurance, and Personal Belongings

14.1. Each Traveler is responsible for having valid identification and, for routes that cross a border (for example, into Canada), a passport, visas, and any other permits required to enter and re-enter. If a Traveler is denied entry at a border or into a park because of their documents, no refund is given.

14.2. Insurance is not included in the tour price. We strongly recommend purchasing travel medical insurance and trip cancellation insurance.

14.3. You are responsible for your own belongings, money, documents, and electronics. We are not responsible for their loss or damage unless it is our fault.

15. Liability

15.1. We are responsible for organizing and running the tour in accordance with the itinerary and these Terms, with reasonable care and professionalism.

15.2. We are not responsible for:

  • the acts and services of third parties that you receive directly or that are not part of the itinerary (although we will help sort things out if something goes wrong);
  • delays caused by traffic, weather, road work, or ferry and park operations;
  • consequences of a Traveler not following our safety instructions, park and campground rules, or these Terms;
  • costs you incurred outside your agreement with us, such as airfare, accommodation before and after the tour, and lost vacation days.

15.3. To the maximum extent permitted by law, our total liability to you under the agreement is limited to the amount you paid us for the tour, and we are not liable for indirect or consequential damages or lost profits. Nothing in these Terms limits any liability that cannot be limited by law, including liability for death or personal injury caused by our gross negligence or willful misconduct.

15.4. Each Traveler is responsible for any damage they cause to us, to other Travelers, and to third parties.

16. Photos, Videos, and Reviews

16.1. During the tour, we take photos and videos, which you will receive after the trip. We may use some of this material on the Website and our social media. If you prefer not to appear in our posts, let us know before or during the tour, and we will not publish material in which you can be recognized. We will remove anything already published at your request.

16.2. We would be grateful for an honest review. We publish reviews only with your permission and may shorten them without changing their meaning.

17. Use of the Website

17.1. The text, photos, videos, design, logo, and The RV Escape name are owned by us or used by us lawfully. They may not be copied, distributed, or used for commercial purposes without our written permission.

17.2. Information on the Website is provided for general reference and may be updated. Your booking is governed by the information in effect on the booking date and by what is stated in your booking confirmation.

17.3. You may not use the Website to send spam, submit false inquiries, attempt to hack it, or engage in any unlawful activity.

18. Complaints and Disputes

18.1. If something isn’t right during the tour, please tell us right away; we can resolve most issues on the spot.

18.2. You may send a written complaint to hello@thervescape.com no later than 30 days after the tour ends. We will respond within 14 days.

18.3. Before disputing a payment with your bank or payment service (a chargeback), please contact us; this will resolve the issue faster. If a payment is disputed, we may provide the bank or payment service with these Terms, your booking confirmation, and our correspondence.

18.4. We will try to resolve any disagreements through good-faith discussion. If we cannot reach an agreement, the dispute will be heard in the state courts of New Jersey or the federal court located in New Jersey, unless the law gives you the right to bring a claim in a court where you live. Either party may bring a claim in small claims court if the dispute falls within that court’s jurisdiction.

18.5. The agreement is governed by the laws of the State of New Jersey and US federal law, without regard to conflict-of-laws principles.

19. Personal Data

By booking a tour, you agree that we process Travelers’ data as described in our Privacy Policy and Cookie Policy.

20. Final Provisions

20.1. We may update these Terms. The new version is posted on this page and applies to bookings made after it is posted. Your booking is governed by the version in effect on the date you paid your deposit, unless we have agreed otherwise with you in writing.

20.2. If any provision of these Terms is found to be invalid, the remaining provisions remain in effect.

20.3. These Terms are published in English and Russian (the Russian version is titled «Публичная оферта»). If there is any conflict between the versions, the English version prevails.

20.4. Our failure or delay in exercising any right under these Terms does not waive that right.

20.5. You may not transfer your rights and obligations under the agreement to anyone else without our consent, except for replacing a Traveler under Section 7.5.
